Visiting the website
This website does not set cookies, does not use analytics or advertising services and does not embed third-party content; the fonts are also delivered with the website itself.
The website is hosted by Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA (Cloudflare Pages). When you visit it, Cloudflare processes technically necessary data (IP address, time, page requested, browser identifier) in order to deliver the pages via its server network and to protect the website against attacks (Art. 6(1)(f) GDPR). Cloudflare acts as our processor (Art. 28 GDPR). Cloudflare is certified under the EU-U.S. Data Privacy Framework; the transfer to the USA is based on Art. 45 GDPR. Cloudflare stores these data only as long as necessary to deliver and protect the website; we ourselves do not store any log files.
Enquiries by email
When you write to us, we process your details in order to answer your enquiry and, where applicable, to prepare and perform a contract (Art. 6(1)(b) GDPR). Our email service is Google Workspace; Google acts as our processor (Art. 28 GDPR). Data may be transferred to the USA; Google LLC is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR).
WhatsApp and Instagram
WhatsApp and Instagram are only linked on the website; no data are transmitted to these services when you visit our pages. Once you click through to Instagram, Meta’s privacy policy applies. If you write to us via WhatsApp, we process your phone number and message in order to answer your enquiry (Art. 6(1)(b) GDPR). The service is provided by WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland; data may be transferred to the USA. Its parent company, Meta Platforms, Inc., is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR). If you do not want this, please write to us by email.
Invitation list
If you ask us by email to add you to our invitation list, we store your name and email address and send you invitations to exhibitions by Artsürem Berlin (Art. 6(1)(a) GDPR). We keep your sign-up email as proof of your consent. You can withdraw your consent at any time with effect for the future, for example by email to [email protected]; we will then remove your address from the list.
Open Call applications
If you apply for the Open Call, we process your details, your CV and the images of your works in order to review your application and, where applicable, to prepare an exhibition (Art. 6(1)(b) GDPR). If no collaboration results, we delete the documents no later than one year after receipt.
Purchase and delivery
For the offer, contract, payment, export and customs clearance, we process your name, address, contact details and payment details (Art. 6(1)(b) GDPR). We fulfil customs obligations under EU law on the basis of Art. 6(1)(c) GDPR. We pass these data on to the delivery and shipping companies we engage, to our bank and to the customs authorities of Turkey and of the country of import insofar as this is necessary for delivery. We retain contract, invoice and customs documents for ten years from the end of the calendar year in which the contract was performed, owing to Turkish commercial and tax law obligations; this is based on our legitimate interest in meeting these obligations (Art. 6(1)(f) GDPR).
Seat in Turkey
Our company is based in Turkey; your details therefore reach us directly in Turkey. The European Commission has not adopted an adequacy decision for Turkey; the level of data protection there therefore does not necessarily correspond to that in the EU. We process your data in accordance with the GDPR (Art. 3(2) GDPR); you can assert your rights against us using the contact details above.
Storage period
We delete enquiries that do not lead to a contract no later than two years after the last contact; this also applies to WhatsApp messages. We keep your address on the invitation list until you unsubscribe. The periods for contract documents and applications are stated above.
Provision of data
You are not required by law or contract to provide your data. Without your contact details, however, we cannot answer your enquiry; for the conclusion of a contract and delivery, we need your name, address and contact details. There is no automated decision-making, including profiling.
Your rights
You have the right of access and the rights to rectification, erasure, restriction of processing and data portability (Art. 15 to 20 GDPR). You can withdraw any consent you have given at any time with effect for the future. You can lodge a complaint with a data protection supervisory authority, for example the Berlin Commissioner for Data Protection and Freedom of Information.
Right to object
Where we process your data on the basis of Art. 6(1)(f) GDPR, you may object to this processing at any time on grounds relating to your particular situation (Art. 21(1) GDPR). We will then no longer process your data unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
